Coordinated Early Intervening Services

Coordinated Early Intervening Services (CEIS) are intended for students who have not been identified as students with disabilities under IDEA but who are determined to need additional academic and behavioral supports to succeed in general education. Coordinated Early Intervening Services may be used for students in kindergarten through grade 12, with a particular emphasis on students in kindergarten through grade three.

CHANGES: Beginning with the 2008-09 ISES Year End records, "Coordinated Early Intervening Services" will be required for districts identified as having significant disproportionality and districts requesting to use funding for CEIS.

USES: The implementing regulations to IDEA require, in 34 CFR §300.226(d), each LEA that implements CEIS to report to the State on the number of children who received CEIS and the number of those children who subsequently received special education and related services under Part B during the preceding two-year period (i.e., the two years after the child has received CEIS). ANSWERS TO QUESTIONS ABOUT COORDINATED EARLY INTERVENING SERVICES

1. May a district elect to provide Coordinated Early Interventing Services?
   • The Individuals with Disabilities Education Act (IDEA 2004) contains a provision, 20 U.S.C. 1413 (f), which permits local educational agencies (LEAs) to use up to 15 percent of their Part B funds for any fiscal year to develop and implement coordinated early intervening services (CEIS). This provision became effective July 1, 2005.
2. Must a district identified as having significant disproportionality spend the entire 15% of CEIS activities?
   • Yes. In the case of determination of significant disproportionality with respect to the identification of children as children with disabilities, the placement in particular educational settings of such children, or disciplinary actions, the SEA must require the LEA to reserve the maximum amount (15%) it receives under Part B of IDEA to provide comprehensive coordinated early intervening services (CEIS) to serve children who have not been identified as children with disabilities in the LEA, particularly, but not exclusively, children in those groups that were significantly overidentified. [34 CFR §300.646(b)(2)]. The Department interprets the phrase “reserve the maximum amount of funds” as meaning to use the funds for early intervening services. The statute does not authorize LEAs to use these funds for any other purpose. It is important to note that the obligation to use 15% of the LEA’s IDEA funds for CEIS is triggered solely on a determination of significant disproportionality. In other words, the obligation to reserve funds for CEIS occurs independent of any analysis of whether that disproportionality is the result of inappropriate identification.
