ESEA Flexibilities

ESSA provides greater flexibility LEAs to do what is best for children while maintaining important protections for historically underserved students, including economically disadvantaged students, students with disabilities, and English learners. The hyperlinks below provide more information about flexibilities available to LEAs.

When implementing the flexibilities described on this webpage, LEAs must continue to comply with Federal civil rights laws that prohibit discrimination based on race, color, national origin, sex, disability, and age. These laws include Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act, the Age Discrimination Act of 1975, and the Equal Educational Opportunities Act of 1974.

Transferability  Local Education Agencies (LEAs) may transfer funds they receive by formula under certain programs to other programs to better address state and local needs.

Rural Education Achievement Program’s Alternative Fund Use Authority (REAP-AFUA) give LEAs who are SRSA eligible more options for spending its Title II, Part A and Title IV, Part A formula funds.

ED-Flex Waivers allows DPI to waive certain statutory or regulatory requirements applicable to any of the following programs: Title I, Part A; Title I, Part C; Title II, Part A; and Title IV, Part A.
