USDA Policy Memorandum SP 02-2022: Updates to the Federal Micro-Purchase Threshold in 2 CFR 200.320(a)(1)

The Food and Nutrition Service (FNS) has received questions regarding changes made in November 2020 by the Office of Management and Budget (OMB) to the federal informal procurement method, micro-purchases, and the micro-purchase threshold in government-wide regulations at 2 CFR 200.320(a)(1)(i)-(v). The purpose of this guidance is to make State agencies and program operators aware of regulatory changes made by OMB which they may utilize at their discretion. These changes may be helpful to program operators experiencing challenges related to supply chain disruptions.

Updates to the Federal Micro-Purchase Threshold

USDA recently notified State agencies of the changes made by Office of Management and Budget (OMB) to the Federal informal procurement method, micro-purchases, and the micro-purchase threshold in 2CFR 200.320(a)(1)(i)-(v). This memo applies to the National School Lunch Program (NSLP), School Breakfast Program (SBP), Child and Adult Care Food Program (CACFP), and Summer Food Service Program (SFSP). The memo supersedes SP20 CACFP07 SFSP06-2019-Revised. The changes impact state and local operators conducting procurement with federal funds.
 
The main changes include:
  • Micro-Purchase Threshold: The threshold increased to $50,000. Regulations now state that program operators are “responsible for determining and documenting an appropriate micro-purchase threshold based on internal controls, evaluation of risk, and documented procurement procedures.” The threshold used “must be authorized or not prohibited under State, Local, or Tribal laws or regulations.” DPI SNT is seeking clarification from USDA Regional Office pertaining to the details of this new threshold. We will provide clarification in the coming weeks.
  • Purchase Distribution: Previous regulations required program operators to distribute micro-purchases equitably among qualified suppliers. Language has been changed to state that to the maximum extent practicable, program operators should distribute micro-purchases equitably among qualified suppliers.
  • Award without Competition: Previous regulations stated micro-purchases may be awarded without soliciting competitive quotes if the state agency or program operator considers the price to be “reasonable”. Language has been updated to define how program operators determine a price to be reasonable based on research, experience, purchase history, or other information and documents.

FY 2021 USDA NSLP Equipment Assistance Grant (EAG)

The FY 2021 EAG application is now available and is due by 11:59 PM CST on Wednesday December 17, 2021. Each School Food Authority (SFA) may request a maximum total of $25,000 for up to two pieces of equipment with a minimum price of $1,000 each. The application and instructions to apply are available on the Equipment Grant Webpage. After completing PI-6201 (password: DPIEquipGnt), please download and complete PI-6208 for each requested piece of equipment and email to DPIEquipGnt@dpi.wi.gov.
