We have been receiving questions about the nonresident district requesting records from the 
resident district and that nonresident districts are sending out records requests to resident 
districts.   

As a reminder, per Wis. Stat § 118.51(3)(a)1m., resident school districts must send special 
education and expulsion records to the nonresident district on or before May 11th.  The 
nonresident district does not need to request these records from the resident district.

However, if the pupil is currently attending a public school other than the resident district, the 
nonresident district will have to request the records from the school district of attendance.  You 
should not request records from private schools. 

For resident districts that have sent records before May 11th, please check to see if there are 
any newly developed or revised IEPs for any applicant.  If there are, please send copies to the 
nonresident district.
