On September 24, 2004, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against the Racine Unified School District. This is the department's decision regarding that complaint. The issue is whether the district properly responded to a parent's request, in September 2004, for an individualized education program (IEP) team meeting for her son.
On September 16, 2004, the mother of a child with a disability spoke to her son's special education teacher and requested an IEP team meeting for her son. In response to the parent's request, the district held IEP meetings on October 8 and 14, 2004. The law requires a school district to hold IEP team meetings periodically to review a child's IEP but not less than annually. Parents may request an IEP meeting at any time. A school district should respond to any reasonable parent request for an IEP team meeting. The department concludes that the district properly responded to the parent's request for an IEP team meeting by holding IEP team meetings on October 8 and 14, 2004.
