Department will hold preliminary public hearing on statements of scope for administrative rules

MADISON — The Wisconsin Department of Public Instruction (DPI) will conduct a hearing to accept public testimony on promulgation of administrative rules under a statement of scope on an emergency and proposed permanent rule to amend Chapter PI 34, relating to changes to PI 34 as a result of 2019 Wisconsin Act 44.
 
The proposed rule seeks to make changes to PI 34 to conform the rule to changes in statute as a result of 2019 Wisconsin Act 44, including rules around what constitutes “satisfactory completion” of a course of study that a special education teacher may complete as an alternative to the Foundations of Reading Test (FORT).
 
A statement of scope is prepared in advance of any rule that an agency plans to promulgate. It includes a description of the objective of the rule, a description of existing policies relevant to the rule, an analysis of policy alternatives, the statutory authority for the rule, estimates of the amount of time expected to develop the rule, a description of entities affected by the rule, and a summary of any federal regulation that is intended to address the activities to be regulated by the rule. As the rule is promulgated, the department will conduct an additional public hearing or hearings and comment period for the proposed permanent administrative rules.
 
Those intending to testify will be required to present photo identification at the security desk near the Webster Street public entrance. Those using the building’s Butler Street handicapped accessible entrance should press a doorbell for admittance and check in with security. Written comments received no later than the date of the hearing will be given the same consideration as testimony presented at the hearing. A copy of the scope statement is available on the department’s Administrative Rules webpage or the Wisconsin Legislature Rules site.
