Federal Liability Protection for Food Donation Fact Sheet

President Biden signed the Food Donation Improvement Act (S.5329) on January 5, 2023. The law expands the liability protections given by the 1996 Bill Emerson Good Samaritan Act, by protecting donations made directly to individuals and those purchased for a small, highly reduced fee (covering handling and/or distribution, etc.). See the linked factsheet from Harvard Food Law & Policy Clinic on the updated law.
