IDEA Complaint Decision 04-001

On January 9, 2004, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against the Cambria-Friesland School District. This is the department's decision regarding that complaint. The issue is whether the district, during an Individualized Education Program (IEP) team meeting in October 2003, properly considered the parent's concerns for enhancing her child's education.

The IEP team must consider the parents' concerns and the information that the parents provide regarding their child in developing, reviewing, and revising IEPs. During the IEP meeting on May 20, 2003, the parent's concerns regarding her son's social and emotional development were indicated on the IEP. The IEP also contained goals and objectives that dealt with behavioral concerns. The IEP team properly considered the parent's concerns for enhancing her child's education during the IEP team meeting held in May of 2003. No IEP team meeting has been conducted since May.

This concludes our review of this complaint, which we are closing.
