IDEA Complaint Decision 04-028

On June 3, 2004, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against the Chippewa Falls Area Unified School District. This is the department's decision regarding that complaint. The issue is whether the district, during the 2003-2004 school year, implemented a student's individualized education program (IEP) regarding writing daily assignments into the assignment notebook, providing visual cues, and providing support with homework submission.

Support with homework submission is not listed as a supplementary service in the IEP. However, the district acknowledges that the provisions regarding visual cues and the assignment notebook were not implemented by some staff. The district has taken administrative action, and the principal will continue to meet with staff and monitor actions relevant to the special education process. The district will also send a memo to all teachers at the school regarding their responsibility on following IEPs. Finally, in-service will be provided on classroom interventions and on the responsibility of teachers to follow IEPs. The district will provide the department with documentation that the corrective actions have been completed. The district will also hold an IEP team meeting to determine whether additional services are required because portions of the IEP were not implemented.
