IDEA Complaint Decision 04-056

On November 19, 2004, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against the Adams-Friendship Area School District. This is the department's decision regarding that complaint. The issue is whether the district properly graduated a student with a disability in May 2004.

An individualized education program (IEP) team met on December 8, 2003, to review and revise the student's IEP goals. The student was invited and attended. The student was 18 years old and considered an adult at the time of the meeting. The IEP team determined the credit requirements for graduation would be met by the end of the current school year and the IEP goals would be substantially completed. The district pupil services director confirmed the student met credit requirements for graduation and substantially completed his IEP goals. The director submitted a document to the department demonstrating the student had sufficient credits to graduate. The district sent the student prior written notice of graduation. The student graduated with a regular high school diploma on May 29, 2004. The district followed program procedures and the IEP goals had been completed.

This concludes our review of this complaint, which we are closing.
