IDEA Complaint Decision 05-038

On July 26, 2005, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against the Whitefish Bay Schools. This is the department's decision regarding that complaint. The issue is whether the district, during the 2004-2005 school year, improperly disclosed personally identifiable information from a student's record without obtaining required consent.

The district acknowledges that a student was identified in a yearbook as receiving special education without obtaining required consent and has taken steps to ensure that this will not happen again. The district has spoken with the yearbook advisor and all other relevant parties and has assured the department that they are fully aware of student privacy requirements. The department determines that no further corrective action is required.

This concludes our review of this complaint, which we are closing.
