IDEA Complaint Decision 14-050

On September 11, 2014, the Department of Public Instruction (DPI) received a complaint under state and federal special education law from XXXXX against the Madison Metropolitan School District. The issue is whether the district, in September 2013, properly provided the parent notice of who would be in attendance at the individualized education program (IEP) team meeting scheduled for September 27, 2013.

On October 1, 2014, the district informed the department it agreed it had not properly provided the parent notice of who would be in attendance at the IEP team meeting. Within 30 days, the district shall submit to the department a proposed corrective action plan outlining the steps it will take to ensure district staff properly provide parents notice of who will be in attendance at IEP team meetings. There is no student-specific corrective action required, as the parent attended the meeting which has already occurred.

All noncompliance identified above must be corrected as soon as possible, but in no case more than one year from the date of this decision. This concludes our review of this complaint.
