IDEA Complaint Decision 15-011

On February 23, 2015, the Department of Public Instruction (department) received a complaint under state and federal special education law from XXXXX against the Siren School District. This is the department’s decision regarding that complaint. The issue is whether the district, during the 2014-15 school year, provided special education services utilizing properly licensed staff.

Each school board must ensure every teacher, aide, or other professional staff holds a valid certificate, license, or permit issued by the department for the position for which the individual is employed. Special education services must be provided by properly licensed special education teachers. Paraprofessionals holding a valid special education program aide license may support the provision of special education services under the supervision of an appropriately licensed teacher. All special education teachers and aides who provided or supported the provision of special education services in the classrooms identified by the complainant held appropriate department licenses valid for the 2014-15 school year. The district provided special education services utilizing properly licensed staff.
