On November 12, 2009, the Department of Public Instruction received a complaint under state and federal special education law from XXXXX against the School District of Beloit. This is the department’s decision regarding that complaint. The issue is whether the district, beginning November 12, 2008, properly provided services to a parentally-placed private school student in accordance with the student’s services plan.
The student is enrolled by his parents in a private school located within the School District of Beloit. The student has been designated by the district to receive special education and related services. The student’s service plans in effect, beginning November 12, 2008, called for the district to provide sensitivity training for the student’s teachers and peers at the private school. The student’s teachers have received sensitivity training, but the student’s peers have not.
The district failed to properly provide services to the student in accordance with the services plan. On December 17, 2009, representatives of the district met with the student’s parents and the private school principal to develop a new services plan. The new services plan addresses the need for training for staff and students at the private school. No additional student level corrective action is required. Within 30 days, the district must submit a corrective action plan to ensure, in the future, it properly implements services plans for parentally-placed private school students designated by the district to receive special education and related services.
All noncompliance identified above must be corrected as soon as possible, but in no case more than one year from the date of this decision. This concludes our review of this complaint.
